Alexandra’s Law is simple. If someone is convicted of selling illicit fentanyl, they will receive a warning letting them know that selling this drug is extremely dangerous and can cause death. The warning would be documented and kept on record. If they do not stop and someone dies as a result of their continued action, they can be charged with murder.
Under California law someone can be charged with second degree murder if it can be proven that they knowingly acted with reckless disregard for human life. In a subsequent conviction where a death has occurred, their initial warning would serve as evidence to prove the person knowingly acted with reckless disregard for human life. Under California law this constitutes as murder.
